Merch It Now (“Merch It Now,” “we,” “us,” or “our”) is a software platform operated by Abaco Business Investments LLC, a Florida limited liability company. This Privacy Policy explains how we collect, use, disclose, store, and protect information when you access or use the Merch It Now platform, website, applications, storefronts, integrations, and related services (collectively, the “Services”).
This Policy applies to businesses and organizations using Merch It Now, their authorized users, customers interacting with Merch It Now-powered storefronts, and other individuals whose information may be processed through the Services. By using the Services, you acknowledge the practices described here.
1.Information We Collect
1.1Account and Business Information
When you create or use an account, we may collect names, business or organization names, email addresses, telephone numbers, business and billing addresses, account credentials, user roles and permissions, business settings and preferences, subscription and account information, communications, and support requests. If an employer, organization, or administrator invites you, we may receive information about you from that organization.
1.2Customer and Order Information
Businesses using Merch It Now may provide information about customers, employees, members, recipients, or other individuals, including names, contact details, billing and shipping addresses, organization information, orders and order history, products purchased, sizes, colors, personalization, shipping and fulfillment information, discounts, vouchers, allowances, credits, transaction information, communications, returns, refunds, and adjustments. The business operating a storefront generally determines what information it collects and how it uses that information for its business purposes.
1.3Organization and Program Information
For merchandise, uniform, benefit, allowance, voucher, subsidy, or similar programs, we may process participant names, email addresses, identifiers, organizational affiliations, departments, locations, teams, groups, eligibility information, voucher or allowance balances, program participation, orders, and redemption activity.
1.4Payment and Transaction Information
We may process transaction amount, currency, payment status, payment method type, transaction identifiers, refunds, processor information, and billing information. Card and banking transactions may be processed by third-party processors and financial institutions. When information is entered directly into a processor's system, Merch It Now may receive transaction details, tokens, status, or limited payment information rather than complete card or bank credentials. We do not use payment information for unrelated purposes.
2.QuickBooks Online and Intuit Integration
2.1Information Sent to QuickBooks Online
Customers may optionally authorize Merch It Now to send information maintained in Merch It Now to their QuickBooks Online company. Depending on the features used, this may include customers, invoices, payments, refunds, and related information necessary to create and maintain those records.
2.2Information Accessed from QuickBooks Online
Merch It Now does not import your broader QuickBooks Online accounting records into Merch It Now. It may make limited requests to determine whether a customer, transaction, or associated record already exists, maintain record associations, prevent duplicates, and confirm whether a record was created or updated. Information returned is used only as necessary to operate and support synchronization, not to independently analyze your broader accounting records.
2.3How We Use QuickBooks Integration Data
Integration data is used to create customer records; send invoices; record payments and refunds; check corresponding records; prevent duplicates; maintain synchronization status and associations; identify and troubleshoot errors; and support the integration. We do not sell QuickBooks integration data, use it for advertising or unrelated marketing, or permit third parties to use it for their independent marketing.
2.4Authorization and Disconnection
Merch It Now communicates with QuickBooks Online only after authorization through Intuit. Customers may disconnect at any time through applicable settings. Disconnection stops future synchronization requests but does not remove records already sent to QuickBooks; those records must be managed there. Merch It Now may retain its own customer, order, payment, refund, synchronization, and transaction records under this Policy and applicable recordkeeping requirements.
2.5Customer Responsibility
Customers must determine whether the integration is appropriate, ensure they are authorized to transmit information, and review the accuracy and accounting treatment of transmitted records. Merch It Now facilitates transmission and does not provide accounting, bookkeeping, tax, financial, or legal advice.
3.Payment Processing and Merchant Services
3.1Paystri
Merch It Now works with Paystri to provide certain payment processing and merchant services to eligible customers. Merchant applicants may provide business and contact details, registration and tax information, owner or representative information, identity-verification data, banking and settlement details, business nature and history, transaction information, and other information reasonably required for underwriting, fraud prevention, compliance, or merchant services. Some information is collected directly by Paystri under its own terms and practices. Merch It Now may receive merchant identifiers, onboarding or approval status, transaction and settlement information, refunds, disputes, chargebacks, and other information needed for payment functionality. We do not use underwriting or payment information for unrelated advertising or marketing.
3.2Payment Transactions
Customer payment information may be transmitted directly to the applicable processor. Merch It Now may retain transaction identifiers, payment method type, amount and currency, authorization and payment status, settlement status, refund details, dispute or chargeback information, and limited processor-provided payment information. We do not require complete card numbers where secure processor collection is available. Processors may independently process information to comply with network, banking, anti-fraud, anti-money-laundering, identity-verification, and legal obligations.
3.3Third-Party Payment Terms
Payment and merchant services may be subject to separate applications, agreements, fees, privacy policies, and eligibility rules. Merch It Now does not control independent underwriting or merchant approval decisions.
4.Information Collected Automatically
When you use the Services, we may automatically collect IP address, browser and device type, operating system, access date and time, pages and features accessed, referring pages, session information, application events, errors, performance information, security events, login activity, and general location derived from IP address. We use this information to operate, secure, maintain, analyze, and improve the Services.
5.Cookies and Similar Technologies
Our websites and Services may use cookies and similar technologies to maintain sessions, remember preferences, provide essential functionality, protect accounts, prevent fraud, understand usage, diagnose issues, and measure performance. We may use appropriate third-party analytics technologies. Browser controls may restrict cookies, but disabling essential cookies can prevent portions of the Services from working.
6.How We Use Information
We may use information to provide and operate the Services; create and manage accounts; authenticate users; process and manage orders; facilitate payments and refunds; provide storefront, organization, voucher, allowance, and program functionality; enable requested integrations; synchronize with QuickBooks Online and other authorized services; provide support; send service, administrative, and security messages; maintain transaction and audit records; detect fraud, abuse, and security incidents; diagnose problems; monitor and improve performance; develop features; enforce agreements; comply with law; and protect Merch It Now, customers, users, and others. Where required, processing relies on an appropriate legal basis such as contract performance, legitimate interests, legal obligation, or consent.
7.Businesses and Organizations Using Merch It Now
Merch It Now is primarily a business-to-business platform. Customers may process personal information about their customers, employees, members, participants, and others using our technology. In many circumstances, the customer determines why and how information is processed and Merch It Now processes it to provide the Services. Questions about a particular storefront or program should generally be directed to the business or organization operating it. Where law distinguishes a controller or business from a processor or service provider, the parties' roles depend on the information and activity involved.
8.How We Share Information
8.1Service Providers
We may disclose information to providers supporting cloud infrastructure, hosting, databases, email delivery, communications, security, fraud prevention, monitoring, error reporting, analytics, customer support, payments, shipping, fulfillment, accounting, and other business integrations. They may process information as necessary to provide contracted services and are subject to applicable contractual and legal duties.
8.2Customer-Authorized Integrations
If you enable an integration, we may exchange information with that third party as necessary for the requested functionality, including accounting systems, payment processors, suppliers, shipping providers, and business services. Information received by the provider is also subject to its terms and privacy policy.
8.3Merchants and Organizations
Information relating to a storefront or program may be made available to the merchant or organization operating it so that it can administer orders, benefits, eligibility, fulfillment, service, and related activities.
8.4Legal Requirements
We may disclose information when we reasonably believe it is required to comply with law, regulation, legal process, or government request; protect legal rights; enforce agreements; investigate fraud or security incidents; or protect users, customers, the Services, or others.
8.5Business Transactions
If Abaco Business Investments LLC or Merch It Now is involved in a merger, acquisition, financing, reorganization, asset sale, or similar transaction, information may be disclosed or transferred as part of that transaction, subject to applicable law.
8.6No Sale of Personal Information
We do not sell personal information in exchange for money. We also do not use personal information obtained through QuickBooks Online for targeted advertising or sell or share it for cross-context behavioral advertising.
9.Data Security
We maintain administrative, technical, and organizational safeguards designed to protect information, which may include access controls, authentication, encryption, network security, logging and monitoring, restricted administrative access, security updates, backups, recovery procedures, and personnel access restrictions. No electronic transmission or storage method is completely secure, so absolute security cannot be guaranteed. Users must protect credentials and promptly report suspected compromise.
10.Data Retention
We retain information for as long as reasonably necessary to provide the Services, maintain accounts and transaction histories, preserve accounting and synchronization records, resolve disputes, prevent fraud, meet contractual obligations, and comply with legal, tax, accounting, and regulatory requirements. Periods vary by information and purpose. When no longer required, information may be deleted, anonymized, or securely disposed of, subject to law and legitimate recordkeeping. Backups may retain information for a limited time after deletion from active systems.
11.Access, Correction, and Deletion Requests
Customers and eligible individuals may request access, correction, or deletion by contacting support@merchitnow.com. We may verify identity and authority. We may retain information required for legal obligations, financial or transactional records, disputes, fraud prevention, agreement enforcement, or legitimate business interests. When we process information for a business customer, individuals may need to submit the request to that customer; we will assist as required by law or contract.
12.International Data Transfers
Merch It Now and its service providers may process information in the United States and other countries, including countries different from where information was collected. Where required, we use appropriate legal mechanisms and safeguards for international transfers.
13.Your Privacy Rights
Depending on residence and applicable law, you may have rights to know or access personal information; correct inaccuracies; delete information; obtain certain information in portable form; learn how information is used or disclosed; restrict or object to processing; withdraw consent; and appeal certain decisions. Rights are subject to legal exceptions. We may verify identity and will not unlawfully discriminate against a person for exercising applicable rights. Authorized agents may act where law permits, subject to verification.
14.United States State Privacy Rights
Residents of certain U.S. states may have additional rights concerning access, correction, deletion, portability, targeted advertising, profiling, sale, or sharing. Merch It Now does not sell personal information for monetary consideration. Where a law defines sale or sharing more broadly, individuals may contact us about applicable choices. We may deny or limit requests where an exemption applies and provide an appeal process where required. Florida residents may have rights under the Florida Digital Bill of Rights when that law applies to Merch It Now and the relevant processing.
15.Communications
We may send transactional or service communications about accounts, orders, payments, security, integrations, changes, support, and administration. These may be necessary and not subject to marketing opt-out. Marketing recipients may unsubscribe through the message instructions or by contacting us.
16.Children's Privacy
Merch It Now is a business platform not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without legally required authorization. Businesses and organizations using the Services are responsible for appropriate authority when their programs involve minors. If we learn that information was collected in violation of children's privacy law, we will take appropriate steps.
17.Third-Party Websites and Services
The Services may link to or integrate with third-party products and services. We do not control their privacy practices. Your interactions may be governed by their own terms and policies, including those of QuickBooks Online, Intuit, Paystri, payment processors, shipping providers, suppliers, and other enabled integrations.
18.Changes to This Privacy Policy
We may update this Policy to reflect changes in the Services, technology, law, or business practices. We will revise the Last Updated date and may provide additional notice for material changes through the Services, email, or another reasonable method. Continued use after an updated Policy takes effect is subject to that Policy to the extent permitted by law.
